The county has a rich history and folklore that makes it a favourite for cultural tourism. It was originally known as Chich Onuno (Onuno’s market) but it was renamed to Homa Bay by colonialists in 1925 because it was overlooking the then Huma Hills in Karachuonyo. Visitors from overseas pronounced Huma as 'Homa' and the residents adopted the name Homa Bay. Administratively, Homa Bay County has eight constituencies which also serve as Sub County administrative Units- Mbita, Ndhiwa, Homa Bay Town, Rangwe, Karachuonyo, Kabondo, Kasipul and Suba.

County Solicitor

Duties and Responsibilities:

  • Organize, coordinate and manage administrative and legal functions of the Office.
  • Shall be the Principal assistant of the County Attorney in the execution of functions of the office.
  • Conduct or assign and supervise all cases, including appeals or petitions on behalf of the County Attorney.
  • In consultation with County Public Service Board, be responsible for the supervision of the County Counsel and other members of staff of the Office.
  • In the performance of the functions and exercise of the power under the office of the County Attorney, the County Solicitor will be responsible for formulating and ensuring the implementation of the development of strategies for County Government legal services.
  • Support in drafting and Publication of legislative proposals for the County Government.
  • Ensure amendments where necessary of County laws.
  • Represent the County Government in Court, Tribunals, Commission of inquiry, and any other legal proceedings in which the County is a party or has an interest, other than criminal proceedings, and perform any other function conferred on it by law.
  • Perform the duties of the Accounting Officer in the office of the County Attorney.
  • Performing any other duty as may be assigned by the County Attorney.

Requirements and competencies for an appointment:

  • Be a Kenyan Citizen.
  • Bachelor of Laws (LLB) degree from a recognized University.
  • Be an Advocate of the High Court of Kenya with not less than five (5) years of post-administrative experience.
  • Must satisfy the requirements of chapter six of the Constitution of Kenya 2010.
  • A master’s in law will be an added advantage.
  • Knowledge of records of relevant laws and professional standards.
  • Undertaking legal research and providing sound advisory briefs on legal matters to the County Government.

2 Principal Legal Officers

Duties and Responsibilities:

Responsibilities;

  • The chief policy advisor on issues relating to justice, legal and constitutional affairs, law reform, governance, rule of law, and human rights.
  • Initiate county and legal sectoral policy reform.
  • Coordinate the development and implementation of county policies and laws.
  • Coordinate stakeholder consultations and engagement on matters of policy and legislation.
  • Drafting, reviewing, negotiating, and advising on legal documents agreements, contracts, and MoUs for and on behalf of the county government and its agencies.
  • Ensuring timely contract completion.
  • Must be well vast in the drafting of legal documents including legislation, policy, and litigation.
  • Preparing periodic reports on the execution of contracts, agreements, and MoUs.
  • Researching legal issues and compiling reports, preparing opinions and briefs.
  • Ensuring compliance with principles and values of good governance, human rights, transparency, accountability, ethics, and integrity.
  • Undertaking research on assigned legal issues and analyzing research data and compiling reports.
  • preparing preliminary legal documents/instruments and preparing legal opinions.
  • Undertaking law review and ensuring compliance with county, national, regional, and international instruments.

Qualifications

For appointment to this grade, a candidate must have: –

  • Be A Kenyan Citizen.
  • Bachelor of Law (LL. B) degree from a recognized university.
  • Have been admitted as an advocate for the High Court of Kenya.
  • Be in possession of a current practicing license.
  • Postgraduate Diploma in Legal Studies from the Council of Legal Education.
  • Proficiency in computer applications.
